These Terms of Service (“Terms”) govern your access to and use of the FlowState QSR application and website (“the Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
FlowState QSR is a private team-management tool for the staff and leadership of a quick-service restaurant. It provides features such as scheduling, position deployment, checklists, break tracking, recognition, announcements, and team messaging. We may add, change, or remove features over time.
2. Accounts and access
- Accounts are created and managed by the restaurant’s operator or their designated leaders.
- You are responsible for keeping your login credentials confidential and for activity under your account.
- Access is limited to authorized members of the participating restaurant. Your permissions depend on the role assigned to you.
- The operator may suspend or remove accounts at any time.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful, harassing, discriminatory, or abusive purpose.
- Post content that is threatening, defamatory, or violates another person’s rights.
- Attempt to access data, accounts, or stores you are not authorized to access.
- Probe, scan, disrupt, or attempt to breach the security or integrity of the Service.
- Reverse engineer, copy, or resell the Service except as permitted by law.
Messages and content you post may be visible to your leaders and the operator and may be moderated or removed.
4. Content and data
Content you submit (messages, schedules, logs, profile details) is processed to operate the Service as described in our Privacy Policy. The restaurant operator is the administrator of its workspace and its team’s data. You retain responsibility for the accuracy of information you provide.
Your team is not our marketing list. We do not use a team member’s name, email address or phone number to market FlowState QSR or anything else, to them or to anybody else. We do not sell, rent or licence team data, we do not share it with advertising platforms, and we do not use it to build or seed advertising audiences. The only email we send a team member is a password reset they asked for; the only other messages are push notifications they turned on themselves. This is a term of this agreement, not a policy we can quietly revise: if it ever changes, existing stores will be told before it takes effect and may cancel with a refund of the unused period.
5. Availability
We work to keep the Service available and reliable but provide it on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation, and we may perform maintenance or updates that temporarily affect availability.
6. Intellectual property
The Service, including its software, design, and branding, is owned by the operator of FlowState QSR and is protected by applicable laws. These Terms do not grant you any ownership of the Service. Any third-party names or marks referenced within a store’s content belong to their respective owners.
7. Subscriptions, billing, and cancellation
Using FlowState QSR to run a store requires a paid store subscription, purchased by the restaurant’s operator (owner). Team members use the app at no charge, and only the operator pays. Each store requires its own subscription; one purchase entitles one store.
Where you can buy. Subscriptions are purchased on the web at flowstateqsr.com. Some plans may also be offered as an in-app purchase through the Apple App Store or Google Play. Which plans are available on each channel, and at what price, can differ. The price shown to you at the point of purchase is the price you pay.
Plans (United States pricing; prices may vary by region and are shown before you buy):
- Monthly: $189 per store per month, an auto-renewing subscription.
- Annual: $1,900 per store per year, an auto-renewing subscription.
- Lifetime: $3,600 per store, a one-time purchase that does not renew. Available on the web only.
Groups buying 2 to 5 locations on the web pay $170 per store per month. Groups buying 6 to 15 pay $150 per store per month. Those bands apply automatically at checkout. Sixteen or more locations are quoted with you, not read off this page. Annual billing for a group is ten months of that per-store monthly rate, billed once a year.
Purchases made on the web. Card payments are processed by Stripe, our payment processor. We do not receive or store your full card details. For the Monthly and Annual plans the subscription renews automatically at the same plan and price at the end of each period, and your card is charged at that time, until it is cancelled.
- To cancel a web subscription, email billing@flowstateqsr.com from the address on the account, or contact us using the details in section 11. We will cancel it and confirm by email. There is no phone call and no retention process.
- Cancelling stops future renewals. It does not refund the period already paid for, and your store keeps full access until that period ends.
- 30-day money-back guarantee. If you buy a Monthly or Annual plan on the web and tell us within 30 days of the first charge that it is not working for your store, we refund that charge in full. Email billing@flowstateqsr.com from the address on the account. You do not have to explain why, there is no phone call, and we process it the same business day. The guarantee applies to your store's first purchase, once per store, and to the first charge rather than to later renewals.
- Outside that window, refunds are at our discretion except where a refund is required by law. If something has gone wrong, tell us and we will put it right.
Purchases made through an app store. Where a plan is bought as an in-app purchase, that transaction is with Apple or Google rather than with us:
- Payment is charged to your Apple Account or Google Play account at confirmation of purchase.
- The subscription renews automatically unless you turn off auto-renewal at least 24 hours before the end of the current period, and your account is charged within 24 hours before the period ends.
- You manage the subscription, turn off auto-renewal, and request refunds through your Apple Account or Google Play settings, under that store’s policies. We cannot cancel or refund an app store purchase on your behalf.
- If a free trial or introductory offer is provided, any unused portion is forfeited when you buy a subscription covering the same period, where applicable.
Lifetime purchase. The Lifetime plan is a one-time, non-renewing purchase tied to the purchasing account and to one store. It grants access to that store’s subscription for as long as the Service continues to be offered.
What a subscription includes. An active subscription lets the operator create and run one store workspace, with unlimited team members at no additional charge. If a subscription lapses, is canceled, or is refunded, the store may become read-only after a short grace period. Your store’s data is retained and full access is restored when a subscription is reactivated.
Price changes. We may change subscription prices. Where required by the app stores or by law, you will be notified in advance and asked to consent before an increased price takes effect on a renewal.
Chargebacks. A refund or a chargeback ends access to the store subscription it paid for. Where a purchase was made through an app store, refunds are handled by Apple or Google under their policies and we cannot process them for you; where it was made on the web, see "Purchases made on the web" above.
App Store terms (iOS). The FlowState QSR application is licensed, not sold, to you. Your license is governed by Apple’s Standard End User License Agreement (EULA) as supplemented by these Terms; on matters specific to the App Store, Apple’s terms govern. You acknowledge that:
- These Terms are between you and the operator of FlowState QSR, not Apple, and Apple is not responsible for the application or its content.
- Apple has no obligation to furnish maintenance or support for the application; support is provided by the operator at support@flowstateqsr.com.
- Apple is not responsible for any product warranties, claims that the application infringes intellectual-property rights, product-liability claims, or claims under consumer-protection or similar law; addressing such claims is the operator’s responsibility, to the extent required by these Terms and applicable law.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
Google Play terms (Android). Purchases and subscriptions made on Android are also subject to the Google Play Terms of Service and are managed through your Google Play account.
8. Disclaimers
The Service is a workplace coordination tool. Features such as break reminders and labor settings are aids only and do not constitute legal, employment, or compliance advice. The operator and its leaders remain responsible for following all applicable labor laws and workplace policies.
9. Limitation of liability
To the maximum extent permitted by law, the Service and its provider will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the Service.
10. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
